— Appeal from a judgment of the County Court of Fulton County (Albanese, J.), rendered April 20,1982, upon a verdict convicting defendant of the crime of murder in the second degree. On August 26,1981, the 16-year-old defendant was indicted and charged with rape in the first degree and two counts of murder in the second degree resulting from the August 8,1981 death of 16-year-old Wendy Palmateer.
