I. INTRODUCTION

On April 22, 2009, VOF BouwCombinatie Egmond (“VOF” or “plaintiff’) commenced this action and requested an ex parte order directing attachment and garnishment (“Attachment Order”) of up to $16,980,500 of the assets of Oceanteam Power & Umbilical B.V. (“OPU”), Ocean-team B.V., and Oceanteam A.S.A (together with OPU and Oceanteam B.V., the “defendants”).
