The plaintiff, Jack Regenvetter, brought this action against the defendant, Puget Ball, to recover in damages for the alienation of his wife’s affections. At the trial in the court below, the jury returned a verdict in the plaintiff’s favor for the sum of $27,500. A motion for a new trial was interposed on the various statutory grounds, among which was the ground of excessive damages appearing to have been given under the influence of passion and prejudice. *157The trial court overruled the motion on all of the grounds save the one specifically mentioned.
