Plaintiff Royal Indemnity Company (“Royal”) moves under Rules 12(f) and 56 of the Federal Rules of Civil Procedure for an order striking the defense of subject matter jurisdiction and granting summary judgment. Defendant Wyckoff Heights Hospital (“Wyckoff’) cross-moves for summary judgment and, in the alternative, moves to remand the action to state court for lack of diversity jurisdiction.
