Appeal from a judgment of the Supreme Court (Torraca, J.), entered Novem*886her 30, 1987 in Ulster County, which dismissed petitioner’s application, in a proceeding pursuant to CPLR article 78, seeking jail time credit on a State sentence for time spent in Federal custody on Federal charges.
While out on bail on a Federal bank robbery charge petitioner was charged with conspiracy to break into a United States post office with intent to commit larceny.
