The defendant was arrested on January 4, 1995 and charged in a felony complaint with criminal sale of a controlled substance in the third degree, criminal possession of a controlled substance in the third degree, both class B felonies, and resisting arrest, a class A misdemeanor. The defendant was arraigned in Criminal Court on the felony complaint on January 5, 1995, at which time he was served notice of his right to testify before the Grand Jury, and the case was adjourned until January 10, 1995.
