BROOKS, Judge.

Appellant was convicted of murder in the first degree and his punishment assessed at death. Appellant, a man some thing over forty years of age, lived in the city of North Fort Worth, Texas. In 1891 he agreed to live with Flo B. Knight as man and wife. There was never any marriage license procured, or ceremony performed, but according to the facts before us they continued to live professedly in the relation of man and wife up to the time of the homicide.
