Judgment entered January 13, 1969, in favor of plaintiff after jury trial, unanimously reversed on the law and the facts, and order entered May 21, 1969, permitting amendment to trial transcript, similarly reversed on the law and the facts and a new trial directed, with costs and disbursements to abide the event.
