DIMOND, Justice.

■ The two main questions here are: (1) whether this court has jurisdiction of this appeal, and (2) whether an insurance company is bound by a judgment against its insured where it had refused to defend the action in which the judgment was rendered on the ground that the claim involved was not covered by the policy of insurance.

Arthur Theodore was employed by the Cordova Cold Storage Company as a tally-man on a fish scow. During a storm on August 31, 1955 he was swept overboard and drowned while the scow was anchored about three-fourths of a mile from shore. Shortly thereafter…
