The defendant appeals from his conviction of violation of an abuse prevention order, claiming that his motion to dismiss for failure to grant him a speedy trial in accordance with Mass. R. Crim. P. 36 (b), as amended, 422 Mass. 1503 (1996), should have been allowed. In an unpublished memóran*539dum of decision pursuant to its rule 1:28, the Appeals Court affirmed the conviction, concluding that the Commonwealth had met its burden of justifying the delay.
