This case is presented to us upon an agreed statement, as follows:

“In accordance with the provisions of article 1414 of the Bevised Statutes of the State of Texas, the parties to the above numbered and entitled cause hereby agree on the following statement of the case, and of the facts proven; said statement to be filed among the papers of the cause, and on appeal to be copied into the transcript in lieu of the pleadings and statement of facts.
