This is an appeal in a criminal action tried to the court in the District Court of Sedgwick County in which Thomas B. Carr (defendant-appellant) was found guilty of aggravated burglary (K.S.A. 21-3716) and attempted rape (K.S.A. 21-3301 and K.S.A. 1980 Supp. 21-3502).
The appellant raises three issues on appeal. He contends that (1) the trial court erred in allowing a police officer to offer an expert opinion on whether defendant Carr was intoxicated at the time he was apprehended, (2) the trial court erred in sustaining the State’s…
