COLLINGS, Justice.

This is a suit for a declaratory judgment to construe a contract. It was brought by plaintiffs, Charlie Burgett, Chester Burgett and Edna Duncan Rader, who are heirs at law of Mrs. J. W. (Joe B.) Conway, deceased, against Texas Christian University, residuary legatee under Mrs. Conway’s will, and against Joe K. Orndorff and Robert M. Barton, independent executors of the will and trustees of the residuary estate. The plaintiffs had filed a contest of the will but before the matter was brought to trial in the probate court, they entered into a compromise agreement with Texas…
