This is an appeal from an order of tbe Circuit Court of St. Louis County, sustaining the plea in abatement of defendant Herman Kimmell (respondent), and dismissing tbe cause as to said defendant.

Lena Sanders, plaintiff below (appellant here) filed a petition in tbe Circuit Court of St. Louis County, on April 16, 1931, naming her daughter, Mary Marks; her son-in-law, William Marks, and tbe respondent, Herman Kimmell, as defendants.
