Appeal from a judgment of the Supreme Court (Dier, J.), entered February 2, 1999 in Washington County, which, in a combined proceeding pursuant to CPLR article 78 and action for declaratory judgment, granted respondents’ motions to dismiss the petition/complaint as, inter alia, untimely.

Petitioner is the owner of real property in the Town of Kings-bury, Washington County.
