This suit was filed by the county attorney of Midland County, on behalf of the county, against defendants in error to foreclose an alleged abstract of judgment lien on land in Jefferson County. The application for the writ was granted under the tentative view that the affirmance of the trial court’s judgment for defendants by the Court of Civil Appeals, was erroneous, due to a misconstruction of articles 5447, 5448 and 5449 of the Revised Civil Statutes (1925).
