DIETRICH, Circuit Judge.

The appellant and one Jude Eurcht were adjudged guilty upon two indictments, which by agreement of the parties were consolidated for trial.

In the first, No. 1462, there are two counts, each charging the two defendants jointly with a specific offense as defined by section 4 of the Motor Vehicle Theft Act (41 Stat. 324 [18 USCA § 408]). The second count, relating to a Hudson speedster, was dismissed as to appellant.
