OPINION OF THE COURT

Memorandum.

Ordered that the judgment is reversed, without costs, and the matter is remitted to the Civil Court for the entry of a judgment in favor of plaintiff in the principal sum of $5,000.

In this small claims action, plaintiff, who purchased a condominium unit from defendant, the sponsor of the condominium, seeks to recover the principal sum of $5,000. At a nonjury trial, plaintiff testified that defendant had failed to complete certain agreed-upon repairs to his condominium unit, and that roof leaks had damaged his window shade.
