This court has jurisdiction of this action by virtue of Title 28 U.S.C.A. § 1346, and venue is vested in this court under the provisions of Title 28 U.S.C.A. § 1402 (a).

The parties have filed a stipulation of facts, affidavits supporting their contentions and documents relating thereto. The stipulation of facts provides that the cause be submitted to the court for final decision on the record.
