—In an action to recover a commission for the sale of real property, the plaintiff appeals, as limited by its brief, from so much of an order of the Supreme Court, Suffolk County (Floyd, J.), dated April 25, 1991, as, upon reargument, adhered to a prior determination of the same court, dated January 17, 1991, which granted the defendant’s motion to dismiss the complaint pursuant to CPLR 3211 (a) (1) and (7) on the grounds that there are complete defenses founded upon documentary evidence and the complaint fails to state a cause of action, and which directed the plaintiff to pay the defendant…
