This is a second appeal in this case. The opinion in the former appeal is to be found in (Tex.Civ.App.) 238 S.W. 725. The statement of the case made in that opinion is here adopted as a correct statement in this appeal, but supplemental statements will be made when deemed necessary to explain a particular ruling.
