Defendant, Mack A. Tompkins, was indicted for the murder of Cornelia Reese. On May 9, 1972, he filed a pretrial motion to suppress physical evidence consisting of clothing and shoes allegedly taken from him without a warrant in violation of the Constitution of the State of Illinois. At trial defense counsel moved to orally amend this petition on its face to include an assertion that the introduction of this evidence would be in violation of section 108 — 2 of the Illinois Code of Criminal Procedure (Ill.
