—Appeal from an order of Supreme Court, Monroe County (Ark, J.), entered August 8, 2000, which denied plaintiffs motion seeking to set aside the stipulation of the parties and granted defendant’s cross motion seeking an award of attorney’s fees in the amount of $500.

It is hereby ordered that the order so appealed from be and the same hereby is unanimously modified on the law by denying defendant’s cross motion and vacating the award of attorney’s fees and as modified the order is affirmed without costs.
