2Per curiam

This case came before a panel of the Supreme Court for oral argument on December 17, 1996, pursuant to an order directing the parties to show cause why this appeal should not be summarily decided. The defendant has appealed from an order of the Superior Court granting the plaintiffs motion for a new trial.

After hearing arguments of counsel and reviewing their memoranda submitted pursuant to that order, we conclude that cause has not been shown and the appeal will be decided at this time.
