Appeal by the plaintiff, Christian Andres, from a judgment of the .Municipal Court of the city of New York, borough of Brooklyn, in favor of the defendant, entered on the 15th day of March, 1900.

Woodward, J.:
This action was brought to recover damages alleged to have been sustained by the plaintiff through the negligence of the defendant. The action was tried before the court without a jury, and- at the close of the plaintiff’s case the complaint was dismissed.
In a memorandum filed by the trial court, upon rendering the judgment appealed from, it is said that.the complaint was dismissed “ on the ground that the plaintiff was guilty of contributory negligence.” The return contains a similar statement.
