ORR, District Judge.

A stipulation was filed in this case, signed by the attorneys for the defendant, containing, among other things, a waiver of trial by jury. The case, therefore, was tried by the judge. Ir. said stipulation many facts were agreed upon. To supplement said stipulation, the testimony of several witnesses was taken. During the taking of the testimony, various objections were made by the attorneys for the plaintiff, all of which, except where now and then a par-ti :ular question was withdrawn, were overruled, with the intention of tire court to grant an exception to each ruling.…
