The matter before the Court is the “Amended Motion for Order Affirming that the Provisions of the Automatic Stay Do Not Apply to the Property Located at 104 Water Street, Medford, MA and for Relief from the Automatic Stay to Proceed with State Court Action to Secure Possession” (the “Stay Relief Motion”) filed by 104 Water Street Lending Trust (“104 WSLT”) on July 14, 2005.
