SUMMARY ORDER

Carlos Savinon appeals the denial of his 28 .U.S.C. § 2254 petition to vacate his New York State conviction for first-degree rape and first-degree sexual assault. In an order dated September 13, 2007, this court granted a certificate of appealability on the following issue: whether Savinon’s trial counsel rendered ineffective assistance when attempting to secure an eyewitness’s testimony and when challenging the issued missing-witness charge.
