The defendants, the Metropolitan Electric Protection Company, a corporation having its office at No. 130 West Twenty-sixth street, borough of Manhattan, and its president, Simon B. Hess, are charged with the crime of nuisance in that they did wilfully and unlawfully cause and permit an electric gong and bell to strike and ring at unlawful hours at premises No. 26 West Seventeenth street.

The defendants have moved to dismiss the indictment upon the ground that it is founded upon incompetent and insufficient legal evidence and not sufficient to constitute a crime.
