COXE, Circuit Judge.
The question at issue is a simple one. Leo Poslusny was born in Austria, November 24, 1881, and came to this country April 25, 1891, when he was between nine and ten years of age. On April 22, 1909, he petitioned for naturalization, based upon a declaration of intention filed by his father July 31, 1889, and was admitted to citizenship July 22, 1909, pursuant to the provisions of section 4 of the act of June 29, 1906 (34-Stat. 596, c. 3592 [U.
