(After stating the facts.) The petition alleged that N. S. West was the vice-principal of the defendant, and the defendant contends that the - evidence introduced failed to establish this allegation, and that, under the evidence, West was only a fellow-servant, and hence the defendant was not liable to the plaintiff for his negligence. The case absolutely turns on this question; for, as to the other allegations of the petition, the evidence of the plaintiff is sufficient to establish them as they are therein laid.
