The above-entitled cause is now being determined on defendants’ appeal on questions of law from the judgment of the Court of Common Pleas of Franklin County, Ohio.

On November 24, 1934, at about 9:30 at night,, the plaintiff, Ora J. Fox, while operating his Ford coupe,' came in contact with a moving traction car of the defendants, and by ■ reason thereof plaintiff was severely injured.
