COCHRAN, District Judge.
This is an indictment against the defendant for carrying on the business of a retail liquor dealer without having paid the special tax required by law. It appears from the agreed statement of facts that on divers occasions, before the finding of the indictment, one W. H. Welsh, of Johnson county, Ky., *597gave to the defendant’s salesman in said county an order on defendant to ship to him at Whitehouse, in said .county, by express, C. O.
