This is an action to recover compensation for persona:! injuries received in the late evening of August 16, 1919, on Shrewsbury Street in Worcester, by the plaintiff, then eleven years of age, through being struck by an automobile owned and operated by the defendant. There had been a celebration with fireworks earlier in the evening. At *392its conclusion the plaintiff on the northerly sidewalk with others followed for some distance a band parading in the street.
