McCLENDON, j.

This was an action by Bamon Barreda to recover against Craig, Thompson & Jeffries a balance of $2,394 upon a contract by which plaintiff sold defendants certain cattle. Judgment was rendered in the trial court in favor of plaintiff for the *178full amount sued for upon an instructed verdict. The Court of Civil Appeals reversed this judgment, and remanded the cause for further trial. 200 S. W. 868.

The only assignments of error in the Court of 'Civil Appeals relate to the action of the trial court in directing a verdict for plaintiff, and the only question for determination Is whether…
