This action is brought by plaintiff to recover damages for the burning of certain cord-wood, on the 26th day of May, 1873. The complaint alleges: “ That the defendant by its agents, servants and employees, not regarding its duty in that respect, so carelessly and negligently ran and managed its locomotives, that the said wood was fired and completely destroyed by fire carelessly and negligently dropped and thrown from said locomotives, by the said servants and employees of the said defendant.” On the trial the court permitted witnesses to testify that previous to May…
