Appeal by the plaintiff, Simon J. Weaver, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of Monroe on the lYth day of July, 1901, upon the decision of the court rendered after a trial at the Monroe Special Term.

Spring, J.:

This is an action for separation by the husband, pursuant to section 1762 of the Code of Civil Procedure. The parties intermarried in 1888, and apparently lived happily together until about the time of the commencement of this action. The plaintiff is a hardware merchant in the city of Rochester, sensitive of his financial standing and reputation among the people of the city.
