The parties’ application to approve defendant’s waiver of indictment and guilty plea to a superior court information is denied.
This action commenced with the filing of a felony complaint charging defendant with criminal sale of a controlled substance in the third degree and resisting arrest. There was no preliminary hearing and the defendant did not waive a hearing.
