Bennie and Betty Mitchell sued Contractors Specialty Supply, Inc. (“CSSI”), claiming that CSSI manufactured the allegedly defective synthetic stucco cladding used in the construction of their home. They asserted claims against CSSI for strict liability, negligence, negligent misrepresentation, breach of contract, fraud and bad faith. Finding that the applicable statute of limitation had expired, the trial court granted CSSI’s motion for summary judgment.
