This action is brought primarily for the purpose of having the certificates issued by Frank Sullivan Smith, as receiver of the Pittsburg, Shawmut and Northern Railroad Company, declared a lien upon the Central New York and Western Railroad Company prior to the bonds and mortgage, made and executed by the latter company on the 15th day of Decern*483her, 1892, and merged in a decree of foreclosure and sale granted May 9, 1907, in an action entitled “ Pacific Improvement Company v.
