PEDEN, Justice.
This is an appeal from a judgment against the insurer in a suit on an automobile insurance policy.
Appellee William Bennett had, in an earlier suit filed in Polk County against Southern Industries, Inc., Siesta Furniture Manufacturing Company, Inc. and John W. Garrett, alleged that he was injured on December 5, 1959 when a 1959 International Truck-tractor and Semi-trailer, driven by Mr. John W. Garrett, ran into the rear end of his pick-up truck.
