Yeegeb, J.:

The plaintiff in error was indicted at the October term, 1850, of the circuit court of Wayne county, for an assault and mayhem committed upon Richard Dodd, by cutting out his eyes with a knife. On the trial, the proof clearly established the fact of mayhem, which it appears was committed in the year 1833. The proof also showed that immediately, and in less than a year after the commission of the crime, the plaintiff in error fled and absconded from justice, and was not within the county of Wayne, where the crime was committed, until within twelve months before the indictment on…
