On appeal, Robert Davitt (Robert) claims he presented satisfactory evidence to establish he was the common law spouse of Helen Duffy (Helen); 1 thus, the circuit court erred in affirming the probate court’s determination that Robert was not entitled to an elective share of Helen’s estate.
