TRIEBER, District Judge.
The indictment in this case contains six counts. The first, fourth, fifth, and sixth are based upon section 29b (2) of the bankruptcy act (Act July 1, 1898, c. 541, 30 Stat. 554 [U. S. Comp. St 1901, p. 3433]), and charge the defendant with making a false oath to the schedule of assets of the Alphin & Take Cotton Company, a bankrupt corporation of which the defendant was president.
