*34I. FACTUAL AND PROCEDURAL HISTORY

On October 16, 2000, plaintiffs Tami Brown and Jeffrey Williams filed a complaint against defendants Dominick W. Marraccini and the City of Easton, alleging negligence arising out of an automobile accident. According to the plaintiffs’ complaint, on or about October 20, 1998, at approximately 9 a.m., plaintiff Tami Brown was operating a motor vehicle in which Jeffrey Williams was a passenger.
