'This is an action for- personal injuries under the Federal Employers’ Liability Act, in which the respondent obtained a judgment in the sum of $17,000 in the Circuit Court of the City -of St. Louis. The appellant has duly appealed. In Division One of this Court an'opinion was prepared by Sturgis, C., who.reversed the judgment. On account of á dissenting opinion of the late lamented Frank, J., the cause was' transferred to the Court en Bane and it was assigned for an opinion.
