The defendant, Guntis Utinans, was indicted by the Cook County Grand Jury on January 3, 1972. The indictment charged that Utinans, along with Michael Briseno (hereinafter Michael), Paul DiMartino, and Richard Briseno (hereinafter Richard), committed the offenses of rape, aggravated kidnapping, deviate sexual assault (oral copulation), indecent liberties with a child (two counts—oral copulation and sexual intercourse), and contributing to the sexual delinquency of a child (two counts—oral copulation and sexual intercourse).
