Appeal from the City Court of Birmingham. Tried before the Hon. W. W. Wilkekson. This action was brought by M. F. Hansford, as administratrix of Tlios. Hansford, deceased, against the: Tennessee Coal, Iron & Railroad Company, to recover damages for the alleged negligent killing of the plaintiff’s intestate. The complaint as amended contained twelve counts. The court gave the general affirmative charge in favor-of the defendant on each of the counts except the seventh.

This is an action for damages for an alleged negligent killing of appellee’s intestate by a locomotive engine while being operated 'by tbe servants *361and. employés of the defendant company over its track or road.
