The publication complained of was as follows: “THE RUNNING DISGRACE OF GRACE. “ On Monday, just as attorney Grace was shaking the dust of Highland off his feet and removing himself mysteriously out from among the men and things that had known him for so many years, the sheriff of this county was wending his way to the quiet, thrifty, law-loving Christian village that Mr. Grace was so stealthily leaving.

This action was brought to recover damages for the publication of a libelous article in a newspaper controlled and published by the defendant, in the county where *646the plaintiff and defendant both resided, charging the plaintiff with gross misconduct in his official character as a public officer, and scandalous and infamous conduct as a private citizen. The defendant justified the publication of the article, and alleged the truth of the material facts charged therein.
