This appeal arises from an order of the district court granting summary judgment for the United Mine Workers of America (the “Union”) against Big Horn Coal Company (the “Company”) and denying the Company’s cross-motion for summary judgment. 715 F.Supp. 1060. The disputed issue is whether the Company has an obligation to submit to arbitration certain grievances which arose after the expiration date of the parties’ collective bargaining agreement.
